1. What are we buying exactly, and how does the purchase happen?

Today, the investor is purchasing a "Class B" membership share certificate in Black Creek Village Development LLC. The current cost of a "Class B" membership share is $60,000.00. and there is a limited number of shares available. These shares are purchased by completing the necessary forms found on this web site, and sending them with an investment check to the offices of Black Creek Village Development LLC. Back to top

2. What are "Class B" shares?

There are two classes of shares of the company. "Class A" shares are held by the founders of Black Creek Village Development LLC. "Class B" shares held by investors who will have real property purchase opportunities associated with this initial release. "Class B" shareholders do not participate in profits or expenses of the company and do not have voting rights. Back to top

3. What is the investment value of a "Class B" share then?

When the property plat is recorded, each Class "B" share holder may "swap" their certificate evenly for a contract on a home site (lot) in the development. The investor will not be required to make any further investment to take ownership of their lot, other than normal closing costs and utilities tap fees. Back to top

4. How will the lots be awarded and when?

5. When does our investment become non-refundable?

Immediately. The investment is not a deposit, nor is there to be any implication that the investment is held in trust or escrow. The investment is for the purchase of a "Class B" share of the company that is eligible later be traded for real property in the development.

6. Can I sell or assign my membership certificate?

"Class B" shares are not assignable. However, once the share has been exchanged for a contract on a lot, that contract is fully assignable to another investor/buyer. Back to top

7. Can I use IRA funds to purchase the "Class B" share(s) of the company?

8. Why is this investment opportunity so unique compared to the normal preconstruction process I am familiar with?

A normal preconstruction purchase involves the buying and selling of real property. For this transaction, the investor is purchasing a share of a company that will afford the investor an exclusive opportunity to obtain real property at a later date. Since the investment is being made very early in the life of the development, there is a stronger upside profit potential for each investor. Comparable lots in similar developments have been estimated by local real estate professionals at $100,000 to $150,000 each. Back to top

9. What is my real estate agent’s involvement in the actual purchase of my share of the company?

NONE! Your realtor cannot sell membership interests in a company. Your realtor can bring you information regarding who to contact in order to obtain membership interest, however you will be actually be purchasing the membership share certificates directly from Black Creek Village Development LLC.
